Definitions
Advertiser: a person or business posting details of a job position on the Website
Job Board: the Internet equivalent of a job noticeboard, on which vacancies are posted with the objective of bringing together employers and jobseekers
Jobseeker: a person interested in finding work and posting personal details on the Website
PayPerShop: Paypershop Ltd, a company incorporated in England and Wales, No. 5177476. Registered Office: 11 Grange Park Grove, Leeds, UK, LS8 3BY
Employment Agency: a business that introduces people who are seeking work to prospective employers for the purpose of direct employment by those employers, as defined in the Employment Agencies Act 1973
Employment Business: a business that supplies people who are seeking work to clients for temporary assignments, as defined in the Employment Agencies Act 1973
Website: the PayPerWork website
General
The Website is a Job Board, operated by PayPerShop, for the use of genuine Advertisers and Jobseekers. It specialises in payroll and HR-related jobs. PayPerWork provides a means by which Advertisers may contact Jobseekers for the purpose of considering them for job vacancies. PayPerWork is neither an Employment Agency nor an Employment Business.
PayPerShop does not guarantee any responses to an employment advertisement or that any applicant for a job will be suitable.
By registering to use the Website, the Advertiser or Jobseeker confirms acceptance of these Terms and Conditions. PayPerShop reserves the right to change the Terms and Conditions at any time. In the event of a change, the Advertiser or Jobseeker confirms acceptance of the change by continuing to make use of the Website in any way.
By registering to use the Website, Advertisers and Jobseekers located in the United Kingdom confirm that they will comply with all of the legal requirements imposed on them under UK legislation, including those legal requirements applicable to Employment Agencies and Employment Businesses, the use of personal data under the provisions of the Data Protection Act 1998 and the provisions of statutes that protect individuals against discrimination on the grounds of sex, race, disability, age, sexual orientation or religious belief.
By registering to use the Website, Advertisers and Jobseekers located outside of the United Kingdom confirm that they will equally comply with all of the legal requirements imposed on Advertisers and Jobseekers in the United Kingdom, or with any particular legal requirement imposed by the country in which they are located if it is more stringent.
PayPerShop reserves the right to terminate an Advertiser’s or Jobseeker’s registration and deny any further access to the Website at its absolute discretion, without explanation or notification.
If any provision of these Terms and Conditions proves to be invalid, illegal or unenforceable for any reason, the remaining provisions will continue to have full force and effect.
Copyright
The Website design and pages are copyright and the property of PayPerShop. No external use of any kind may be made of them. However, Advertisers and Jobseekers are permitted to copy or print information displayed on pages for their personal recruitment purposes only.
Such personal recruitment purposes do not include the reproduction of job advertisements on another website except in the case of Employment Agencies and Employment Businesses that are displaying their own job advertisements on the Website in addition to other Job Boards.
Data Protection
All personal information provided by Advertisers and Jobseekers and held by the Website is used in accordance with the Data Protection Act 1998 and the PayPerShop’s registration under that Act. The Data Controller is PayPerShop. Other than the minimum amount of information about Advertisers and Jobseekers that must be made available publicly on the Website in order to introduce the parties to each other, personal information is held confidentially by PayPerShop and is not disclosed to any third parties.
PayPerShop uses cookies to collect and analyse traffic to the Website. The cookie does not contain personal information and is used only for traffic analysis. The information is not used for data-mining or marketing purposes.
By registering to use the Website and providing personal information, an Advertiser or Jobseeker, agrees to the processing of that information by PayPerShop for the purposes of the Website.
By registering to use the Website and providing personal information, an Advertiser or Jobseeker confirms that the information provided is true and accurate. If there is a change in any of the information provided to PayPerWork, the Advertiser or Jobseeker will update the information at the earliest opportunity.
If Advertisers and Jobseekers have indicated that they wish to receive the PayPerWork Newsletter, their contact details will be used for this purpose. No personal information, including names, is given about any Jobseekers in the PayPerWork Newsletter. However, PayPerWork may publish, with the advance written agreement of the parties, details of the successful recruitment of a Jobseeker by an Advertiser.
|f Advertisers and Jobseekers have indicated their agreement, PayPerWork may send them relevant information from third parties in the form of marketing material. Advertisers and Jobseekers may withdraw their authorisation for this use of their information at any time.
When a Jobseeker has agreed that personal information be passed to an Advertiser, PayPerShop is not the Data Controller in respect of any other personal information that the Jobseeker gives to the Advertiser.
In respect of an Advertiser, no personal data about the Advertiser will be retained by PayPerShop, other than required by law, or for anonymous statistical purposes, or in order to send the PayPerWork Newsletter, after a period of fifteen months during which the Advertiser has not held a current advertising plan.
In respect of a Jobseeker, no personal data about the Jobseeker will be retained by PayPerShop, other than as required by law, or for anonymous statistical purposes, or in order to send the PayPerWork Newsletter, after a period of twelve months during which the Jobseeker has not updated any of the personal information held on the Website.
Payment Terms
The services of the Website are provided to Jobseekers free of charge.
The current prices of advertising plans are given on the Website. They are subject to change without notice. Advertisers in the UK will be charged VAT at the current rate on top of the plan prices.
Plans may be paid for (1) by credit card, using the payment facilities provided on the Website, (2) by cheque, or (3) by opening a credit account.
Advertising plans paid for by credit card are available to use immediately.
Advertising plans paid for by cheque will be available to use as soon as the cheque has cleared in PayPerShop’s bank account.
Advertising plans paid for under a credit account are available to use immediately. The payments due under a credit account must be settled within 28 days of the invoice date. Interest will be charged monthly on overdue accounts at the highest fixed interest rate charged by The Cooperative Bank for business loans.
Advertiser’s Obligations
Advertisers must ensure that any advertisement posted on the Website does not contravene the British Code of Advertising Practice or any relevant legislation. Advertisements must not be discriminatory in any way on the grounds of sex, race, disability, age, sexual orientation or religious belief, as defined in UK legislation, or, in the case of Advertisers from outside of the UK, in their own domestic legislation if that is more stringent.
If an Advertiser wishes to post an advertisement that is discriminatory but that relies on the existence of a genuine occupational requirement that is permitted in legislation, the basis for that requirement must be specified in the advertisement.
Advertisers who are Employment Agencies or Employment Businesses must ensure that any advertisement posted on the Website meets their statutory obligations under the Conduct of Employment Agencies and Employment Businesses Regulations 2003.
PayPerShop reserves the right to remove any advertisement that it believes infringes copyright, or is defamatory, or is misleading or inappropriate, or that may make PayPerShop or the advertiser liable to a complaint, claim or legal proceedings.
Advertisers may not endeavour by any means to obtain from the Website information about Jobseekers or other Advertisers to which they do not have authorised access.
Advertisers will treat any applications made online through the website on equal terms with applications received in other ways.
Advertisers will at all times deal professionally and fairly with Jobseekers who respond to an advertisement.
Advertisers agree to indemnify PayPerShop in full against any loss or damage suffered, or any costs incurred, by PayPerShop in defending any claim or proceedings brought by any individual against PayPerShop arising from a breach of these obligations or any of the Terms and Conditions.
Jobseeker’s Obligations
Jobseekers have sole responsibility for any information that they provide about themselves. The information must be true, accurate, up-to-date and not intended to mislead in any way.
PayPerShop reserves the right to remove any information about a Jobseeker that it believes does not meet these obligations.
Jobseekers may not endeavour by any means to obtain from the Website information about Advertisers or other Jobseekers to which they do not have authorised access.
Jobseekers will deal professionally and fairly with an Advertiser in responding to a job advertisement.
Cancellations and Refunds
The Website allows Advertisers to cancel a job advertisement, without charge, before it has appeared. If an advertisement has appeared, irrespective of its duration, it cannot be cancelled and the full charge, as defined for the advertising plan, is due. If payment has already been made, no refund will be given. PayPerShop will give due consideration to any request for a refund where the cancellation was not due to any action or omission on the part of the Advertiser.
Limitation of Liability
Users of the Website acknowledge that the provision of online services using the Internet, by its nature, carries a level of risk that cannot be attributed to PayPerShop. Such risks include the loss of service, email delivery failures, data corruption through the actions of hackers or otherwise, and the transmission of viruses. PayPerShop will not be liable for any loss or damage caused as the result of failures inherent in the Internet.
PayPerShop does not warrant that any information provided by Advertisers or Jobseekers is accurate, reliable, complete or current and will not be liable for any loss or damage caused as a result of inaccurate, out-of-date or misleading information provided by an Advertiser or Jobseeker.
Any article or other information provided on the Website is not legal advice and is not warranted or guaranteed. PayPerShop will not be liable for any loss or damage as a result of treating such information as legal advice. If legal advice is required, a solicitor or accountant should be consulted, or a local organisation providing advice on legal, employment or tax matters.
The provision of links on the Website to services or products provided by third parties is no indication of recommendation or approval by PayPerShop. Users of this site must make their own evaluation of the suitability of products and services by personally contacting the suppliers or advertisers and making decisions on the information that they provide. PayPerShop will not be liable for any loss or damage that results from any such decisions.
Such loss or damage includes any loss of profits or business, or any indirect or consequential loss or damage, whether in action of contract, negligence or other tort action, arising out of or in connection with the use of the site.
The total liability of PayPerShop to an Advertiser for any action or omission by PayPerShop will not exceed the amount paid by the Advertiser for the advertisement, or the cost of providing another advertisement.
Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the law of England and the parties hereby submit to the exclusive jurisdiction of the English courts.
